A quick search for plagiarism articles will reveal that professional instances of intellectual theft have resulted in civil lawsuits and can even be criminally prosecuted under rare circumstances. In addition to the possible legal consequences, professionals may lose their jobs or have to start over in a new field after their acts of fraud are uncovered.

Plagiarism in peer-review reports could be the ‘tip of the iceberg’

Mikołaj Piniewski is a researcher to whom PhD students and collaborators turn when they need to revise or refine a manuscript. The hydrologist, at the Warsaw University of Life Sciences, has a keen eye for problems in text — a skill that came in handy last year when he encountered some suspicious writing in peer-review reports of his own paper.

Last May, when Piniewski was reading the peer-review feedback that he and his co-authors had received for a manuscript they’d submitted to an environmental-science journal, alarm bells started ringing in his head. Comments by two of the three reviewers were vague and lacked substance, so Piniewski decided to run a Google search, looking at specific phrases and quotes the reviewers had used.

To his surprise, he found the comments were identical to those that were already available on the Internet, in multiple open-access review reports from publishers such as MDPI and PLOS. “I was speechless,” says Piniewski. The revelation caused him to go back to another manuscript that he had submitted a few months earlier, and dig out the peer-review reports he received for that. He found more plagiarized text. After e-mailing several collaborators, he assembled a team to dig deeper.

The team published the results of its investigation in Scientometrics in February 1 , examining dozens of cases of apparent plagiarism in peer-review reports, identifying the use of identical phrases across reports prepared for 19 journals. The team discovered exact quotes duplicated across 50 publications, saying that the findings are just “the tip of the iceberg” when it comes to misconduct in the peer-review system.

Dorothy Bishop, a former neuroscientist at the University of Oxford, UK, who has turned her attention to investigating research misconduct, was “favourably impressed” by the team’s analysis. “I felt the way they approached it was quite useful and might be a guide for other people trying to pin this stuff down,” she says.

Peer review under review

Piniewski and his colleagues conducted three analyses. First, they uploaded five peer-review reports from the two manuscripts that his laboratory had submitted to a rudimentary online plagiarism-detection tool . The reports had 44–100% similarity to previously published online content. Links were provided to the sources in which duplications were found.

The researchers drilled down further. They broke one of the suspicious peer-review reports down to fragments of one to three sentences each and searched for them on Google. In seconds, the search engine returned a number of hits: the exact phrases appeared in 22 open peer-review reports, published between 2021 and 2023.

The final analysis provided the most worrying results. They took a single quote — 43 words long and featuring multiple language errors, including incorrect capitalization — and pasted it into Google. The search revealed that the quote, or variants of it, had been used in 50 peer-review reports.

Predominantly, these reports were from journals published by MDPI, PLOS and Elsevier, and the team found that the amount of duplication increased year-on-year between 2021 and 2023. Whether this is because of an increase in the number of open-access peer-review reports during this time or an indication of a growing problem is unclear — but Piniewski thinks that it could be a little bit of both.

Why would a peer reviewer use plagiarized text in their report? The team says that some might be attempting to save time , whereas others could be motivated by a lack of confidence in their writing ability, for example, if they aren’t fluent in English.

The team notes that there are instances that might not represent misconduct. “A tolerable rephrasing of your own words from a different review? I think that’s fine,” says Piniewski. “But I imagine that most of these cases we found are actually something else.”

The source of the problem

Duplication and manipulation of peer-review reports is not a new phenomenon. “I think it’s now increasingly recognized that the manipulation of the peer-review process, which was recognized around 2010, was probably an indication of paper mills operating at that point,” says Jennifer Byrne, director of biobanking at New South Wales Health in Sydney, Australia, who also studies research integrity in scientific literature.

Paper mills — organizations that churn out fake research papers and sell authorships to turn a profit — have been known to tamper with reviews to push manuscripts through to publication, says Byrne.

However, when Bishop looked at Piniewski’s case, she could not find any overt evidence of paper-mill activity. Rather, she suspects that journal editors might be involved in cases of peer-review-report duplication and suggests studying the track records of those who’ve allowed inadequate or plagiarized reports to proliferate.

Piniewski’s team is also concerned about the rise of duplications as generative artificial intelligence (AI) becomes easier to access . Although his team didn’t look for signs of AI use, its ability to quickly ingest and rephrase large swathes of text is seen as an emerging issue.

A preprint posted in March 2 showed evidence of researchers using AI chatbots to assist with peer review, identifying specific adjectives that could be hallmarks of AI-written text in peer-review reports .

Bishop isn’t as concerned as Piniewski about AI-generated reports, saying that it’s easy to distinguish between AI-generated text and legitimate reviewer commentary. “The beautiful thing about peer review,” she says, is that it is “one thing you couldn’t do a credible job with AI”.

Preventing plagiarism

Publishers seem to be taking action. Bethany Baker, a media-relations manager at PLOS, who is based in Cambridge, UK, told Nature Index that the PLOS Publication Ethics team “is investigating the concerns raised in the Scientometrics article about potential plagiarism in peer reviews”.

How big is science’s fake-paper problem?

An Elsevier representative told Nature Index that the publisher “can confirm that this matter has been brought to our attention and we are conducting an investigation”.

In a statement, the MDPI Research Integrity and Publication Ethics Team said that it has been made aware of potential misconduct by reviewers in its journals and is “actively addressing and investigating this issue”. It did not confirm whether this was related to the Scientometrics article.

One proposed solution to the problem is ensuring that all submitted reviews are checked using plagiarism-detection software. In 2022, exploratory work by Adam Day, a data scientist at Sage Publications, based in Thousand Oaks, California, identified duplicated text in peer-review reports that might be suggestive of paper-mill activity. Day offered a similar solution of using anti-plagiarism software , such as Turnitin.

Piniewski expects the problem to get worse in the coming years, but he hasn’t received any unusual peer-review reports since those that originally sparked his research. Still, he says that he’s now even more vigilant. “If something unusual occurs, I will spot it.”

Paraphrase:

“Categorization is now a major field of study. It can be credited to the pioneering work of Eleanor Rosch, the first person to make categorization an issue.”

While the voice is switched in this paraphrase, it still is too close to the original. It uses the same wording and doesn’t credit the source.

Here’s another example:

“In a rare instance of consensus, linguists agree that grammar is extremely complex and hard to properly describe. (Langacker 2008: 27)”

“Linguists rarely agree with each other, but they all acknowledge that grammar is problematic and that it’s nearly impossible to explain it correctly. (Langacker 2008: 27)”

This version has synonyms and adds an extra preposition. Unfortunately, the alternatives "problematic" and "explain" tamper with the original meaning. Let's see how to paraphrase this paragraph properly:

“While linguists rarely share the same opinions, they all admit that grammar is almost impossible to depict comprehensively due to its intricate nature. (Langacker 2008: 27)”

In this case, the concept stays the same. The phrases are changed; there are a new structure and extra conjunction. Perfect!

💬 How to Reword a Quote

If you want your assignments to sound natural, provide the proper context for your quotes. It includes introducing them with phrases such as according to, in the words of, as defined by . Citing is appropriate, if:

  • The wording is especially valuable;
  • You need to support a claim;
  • You want to debate and analyze the author’s position.

Essay Contest: Nappert Prize in International Arbitration 2024

Thanks to the generosity of Sophie Nappert (BCL’86, LLB’86), the Nappert Prize in International Arbitration is celebrating 10 years since its inauguration in 2014. The prize will be awarded by McGill University for the sixth time in 2024.

Eligibility Requirements:

The competition is open to law students, junior scholars and junior practitioners from around the world. To be eligible for the prize, the authors must:

  • be either currently enrolled in a B.C.L, LL.B., J.D., LL.M., D.C.L., or Ph.D. program (or their local equivalents), or
  • have taken their most recent law degree within the last three years; or
  • have been admitted to the practice of law for no more than three years.

Co-authored submissions are permissible, but each author must meet the eligibility criteria. (Kindly note that only one author will be flown to Montreal for the symposium.)

Previous winners of the Nappert Prize (2020 and 2022) are not eligible to submit their essays for this edition.

  • First place: CAN $4,000
  • Second place: CAN $2,000
  • Third place: CAN $1,000

Winners of all three awards will be required to present their essays at a symposium to be held at McGill University’s Faculty of Law in Autumn 2024 (the expenses of the winners for attending the symposium will be covered).

The best oralist will receive an award of CAN $1,000.

The precise date of the symposium will be announced in the coming months.

Deadline and Submission Mode:

All essays must be submitted by 30 th April 2024 11:59PM Eastern Time. Essays can be submitted using this form .

Submission Requirements:

Essays for the prize can be submitted in English, French or Spanish.

Please make sure that your essay:

  • must relate to commercial or investment arbitration;
  • must be unpublished (not yet submitted for publication) as of April 30 th ;
  • must be a maximum of 15,000 words (including footnotes);
  • must be formatted to Times New Roman Size 12 with 1.5 line spacing.
  • should use OSCOLA or any other well-established legal citation guide (e.g. McGill Red Book; Bluebook);
  • should be in MS Word format;
  • should not contain your name or other information about your identity.

Submitted essays should not contain any text generated through advanced automated tools (artificial intelligence or machine learning tools such as ChatGPT), unless specifically required because of the subject matter of the essay and cited as mentioned below. Use of AI-generated text will be considered plagiarism, and any essay containing such text will be disqualified.

If the subject matter of the essay necessitates it, any AI-generated text in the submission should be properly cited. For example, text generated using ChatGPT-3 should include a citation such as:

Mr. Biden’s Republican opponent barely got to introduce himself before time was up for the event, while the dozens of other candidates there for the forum never got a word in.

The episode, from “Only in Delaware,” a political history of Delaware by Celia Cohen, a longtime Wilmington journalist, illustrates just how easily Mr. Biden was able to sweep challengers to the side — not just in that race, but throughout his Senate career. Incumbency gave him a staggering advantage.

In 30 years, Mr. Biden never encountered a serious threat to his office. His Republican opponents were underfunded, little-known, inexperienced or some combination of the three. None of them took more than 41 percent of the vote against him.

His re-election fight against former President Donald J. Trump — his 13th bid for federal office, all told — is shaping up to be the opposite of those long-ago Senate campaigns: travel-intensive, nasty and close. A rival is, for the first time with him atop the ticket, forcing him to make a compelling case for his return.

Before his 2020 presidential campaign, which in the general election was light on in-person events because of the coronavirus pandemic, Mr. Biden had never had a harshly negative advertisement about his record in office or his character broadcast against him on television, according to the archive of congressional television and radio advertisements at the Carl Albert Congressional Research and Studies Center at the University of Oklahoma. None of his Senate rivals attacked him on TV, and he ended his two prior presidential campaigns before opponents got around to attacking him.

The Republicans who ran against Mr. Biden in Delaware described him as a strong incumbent who was widely liked, and much quicker on his feet during debates and candidate forums than the president they see today. Mr. Biden has ramped up his travel schedule with a flurry of carefully managed visits to battleground states in recent weeks, and the 81-year-old president will be expected to keep up the pace while avoiding the sort of verbal flubs that often dog his public appearances.

Just last week, Mr. Biden prompted the crowd at an endorsement event to chant, “Four more years!” and then added “pause” as it appeared to have been written into his teleprompter, an episode that drew much mocking in conservative news media and quiet forehead-slapping among Democrats.

In Delaware, Mr. Biden was so well known and, in his early years in office, had such a wellspring of sympathy from voters after the tragic crash that killed his first wife and daughter, that no rival ever mounted a sustained case that he should not be re-elected. For years, bumper stickers promoting his re-election just said “Joe,” while opponents lost with an array of long-forgotten slogans.

“I don’t think he ever broke a sweat once he was an incumbent,” said Jane Brady, a Republican who lost to Mr. Biden by 27 points in 1990 .

The only negative ad run against Mr. Biden between 1978 and 2008, according to the University of Oklahoma’s archive, is one that his campaign would most likely embrace today. That 30-second spot reminded viewers that President Ronald Reagan endorsed John Burris, Mr. Biden’s Republican challenger in 1984, while Mr. Biden backed the unpopular Democratic presidential nominee, Walter Mondale.

Mr. Biden, the ad stated, opposed Mr. Reagan 58 percent of the time — not exactly in lock step against the Republican president. “You have a choice,” the narrator intoned . “The Reagan-Burris team, the Mondale-Biden team or no team at all.”

Mr. Biden won by 20 points .

Now a 78-year-old retiree, Mr. Burris said it was cost-prohibitive for him to become as well-known to voters as Mr. Biden already was. So he tried to get under Mr. Biden’s skin in order to expose his temper and “create a Bad Joe” that would undercut Mr. Biden’s sympathetic image. In his telling, Mr. Biden did not take the bait.

“Where Trump has absolutely no compunction at going to the basest level he can to try to get a result, I saw Joe moving into that very reluctantly,” Mr. Burris said. “The whole scene now is not emblematic of what he’s used to doing.”

When Mr. Biden first won election to the Senate in 1972 , in an year Democrats took sweeping victories in Delaware, he ousted Senator Caleb Boggs, a two-term Republican and former governor who had been in office in Delaware for 30 years. Mr. Biden’s radio ads coyly suggested Mr. Boggs was pro-heroin and said he was stuck in a generation worried about Joseph Stalin. The ads ended with an upbeat slogan — “Joe Biden: He understands what’s happening today.”

Once elected, Mr. Biden and his early opponents sought to abide by the “Delaware Way,” an informal code of politics that mandated a clubby politeness that had the effect of blurring the differences between the two parties. Mr. Biden’s sons and Mr. Burris’s stepson went to school together. For years after the campaign, the two men golfed together, and as vice president Mr. Biden had Mr. Burris and his granddaughter into the White House.

By the 1990s, that dynamic slowly began to change, though Mr. Biden’s Senate opponents still did not have the resources to mount a negative campaign against him. Ms. Brady, in her 1990 campaign, sought to capitalize on the plagiarism scandal that doomed Mr. Biden’s 1988 presidential run. But without money to amplify the embarrassing story on television, Ms. Brady’s campaign spliced together 11 minutes of network news footage recounting the story on 40,000 VHS tapes and mailed them to addresses on the Delaware voter rolls.

The episode drew howls of protests from the Biden campaign and the news networks. NBC filed a formal protest claiming copyright infringement. But few people actually saw the spliced footage. Ms. Brady’s campaign had a voter list filled with outdated addresses, and she said campaign volunteers wound up fishing VHS tapes out of dumpsters at the Wilmington post office so that they could hand them out at parades and other local campaign stops.

“I wasn’t raising a lot of money, and nobody thought I could win,” Ms. Brady said. “It was a very harsh experience.”

Mr. Biden’s opponent in 1996 and 2002 was Ray Clatworthy, an entrepreneur who owned restaurants and local Christian radio stations. During a 1996 televised debate , Mr. Clatworthy accused Mr. Biden of raising taxes while voting to increase his own salary and accused him of “attempting to portray himself as a conservative” in an election year.

Mr. Biden spoke quickly and precisely, without entering the verbal cul-de-sacs endemic to many of his presidential speeches 28 years later.

Mr. Biden sought to pin down Mr. Clatworthy on his anti-abortion stance and then delivered a clear statement of his own views on the issue after Mr. Clatworthy accused him of flip-flopping to endorse abortion rights in his 1988 presidential campaign.

“My position has been consistent from the very beginning,” Mr. Biden said of his abortion stance. “I believe government should stay out — no constitutional amendment, no public funding.”

Mr. Clatworthy and his family were less enamored by Mr. Biden than some of his other former rivals. When Mr. Clatworthy died in 2021, his family described his political career this way in a paid obituary: “As a patriot, he ran for United States Senate in Delaware twice against a gentleman for whose name we are at a loss.”

Mr. Trump, 77, is a rare president to be defeated while seeking a second term and has a host of political vulnerabilities, including the criminal cases and his role in undoing the constitutional right to an abortion. He has spent most of the days since his New York trial began in court, as is required, while Mr. Biden has hit the campaign trail, making stops in battleground states.

Mr. Biden’s 2024 campaign aides said his 2020 victory over Mr. Trump, who spared little expense in attacking him, is sufficient evidence that he can run a successful and modern campaign.

“After defeating over 20 primary candidates, Joe Biden won more votes than any other candidate in our country’s history and became just the third person to defeat an incumbent president in the last century,” said Lauren Hitt, a campaign spokeswoman. “This November, he’ll beat Trump and the naysayers again.”

The last Republican before Mr. Trump to try to oust Mr. Biden from his office was Christine O’Donnell, who by 2008 had already run for the Senate once and would rocket to political fame two years later when she began a TV ad for a subsequent Senate race with the instantly infamous proclamation: “ I’m not a witch .”

In a rare interview, Ms. O’Donnell, who moved to Florida to attend law school , ticked through the hurdles her 2008 campaign had faced. She said the Delaware Republican Party opposed her brand of conservative politics. Mr. Biden, off running for vice president, refused to debate her , so she was left to appear opposite his surrogates at candidate forums. She believes some voter fraud cost her votes in the state’s most populous county. (There is no evidence of this.)

“In 2008, the Republicans were actually campaigning against me. They were working with Joe Biden to undermine my efforts,” she said. “It’s a shame, because, voter fraud aside, people are pretty conservative in Delaware. You could turn that state red with free and fair elections.”

Ms. O’Donnell said she planned to present her evidence for this in an eight-part podcast that she expects to release this summer.

Prison release of Golden Dawn founder angers Greek anti-fascists

State prosecutor reportedly opposed release of neo-Nazi Nikos Michaloliakos four years into 13-and-a-half-year sentence

The unrepentant founder of Greece’s neo-Nazi Golden Dawn, who insisted followers addressed him as the Fuhrer, has been released from prison four years into a sentence of 13 and a half years, having been convicted of operating a criminal organisation that posed as a political party.

Nikos Michaloliakos, a Holocaust denier and admirer of Adolf Hitler, was allowed to return to his home in Athens this week although his “conditional discharge” was only made public on Thursday.

The news sparked fury among members of the country’s anti-fascist movement. “It’s a scandalous decision,” said Petros Constantinou, the chief coordinator of the front, known as Keerfa. “It did not need to happen and will give the green light to fascists to regroup and continue attacks ahead of the European elections.”

He said operatives of the far-right, ultra-nationalist party still ran branches in Thessaloniki despite it being officially disbanded.

Michaloliakos, an anti-vaxxer who spent a large part of his imprisonment in a rehabilitation clinic after becoming seriously ill during the coronavirus pandemic, was sentenced at the end of a landmark trial to 13-and-a-half years in jail for crimes ranging from violent attacks on immigrants, to weapons offences and the murder of an anti-fascist musician.

Greek media reported his release application had been vigorously opposed by a state prosecutor. The magistrate had argued that despite meeting the criterion of serving three fifths of his jail term, once pre-trial detention was taken into account, the 67-year-old showed no remorse for his actions and should not be set free.

The discharge, agreed by a judicial council in the central town of Lamia, stipulated that Michaloliakos was banned from fraternising with other far-right activists and would have to present himself at a local police station once a month. He was also forbidden from leaving the greater Athens region of Attica.

Golden Dawn rose to prominence during Greece’s near decade-long debt crisis, drawing support from segments of the population who were hit hard by austerity measures that successive governments were forced to enact in exchange for bailout loans from the EU and the International Monetary Fund. At the height of its power, the extremists were the nation’s third-biggest political force, with 18 seats in parliament.

Golden Dawn hit squads sowed such terror on the streets the party was branded Europe’s most violent neo-fascist group. Gangs, often riding motorbikes, dressed in black and wielding batons, knuckledusters and worse, actively sought out and targeted enemies, real and perceived, starting with immigrants and leftists.

Tellingly, far-right parties elsewhere steered clear of the Greek neo-Nazis.

Analysts expressed surprise at the speed with which Michaloliakos’ request for release had been handled. The disgraced leader returned home as the Greeks marked Holy Week, in the run-up to Orthodox Easter this weekend.

“What needs to be asked is whether the criteria that would apply for any other leader of a criminal organisation were applied in this case,” said Kostis Papaioannou, the director of Signal, a research centre tracking the far right. “There’s not a chance in a million that if Michaloliakos were a convicted leader of an armed group of the far left he would be freed like this.”

The move came days after Greece’s supreme court banned another extremist party, the Spartans, from contesting next month’s European elections, arguing the organisation, which has 11 MPs, “aims at the weakening and demise of the democratic political system, particularly through the use of violence or incitement to violence”.

Several of its deputies face charges of electoral fraud, with the fate of the Spartans’ parliamentary group expected to be decided soon by a special court.

“As in other European countries, the far right and its political ideas are gaining traction in Greece,” noted the veteran leftwing author and Golden Dawn expert Dimitris Psarras. “But Golden Dawn does not have any real power or political expression and Michaloliakos is a spent force. His release does not spell danger for Greece.”
